THE UNITED STATES, PLAINTIFF AND APPELLEE, VS. SI CHUN (ALIAS LI CHUAN), DEFENDANT AND APPELLANT.

D E C I S I O N

MORELAND, J.:

VIOLATION OF THE OPIUM LAW; PENALTY. From the Court of First Instance of Manila. Crossfield, J.

Defendant was charged with having smoked opium in violation of section 32 of The Opium Law.  He pleaded guilty, and was sentenced to sic months' imprisonment.  the only point raised on appeal is the allegation that the trial court imposed the maximun penalty in violation of law.  this contention held to be absolutely unfounded , inasmuch as said section prescribes a fine not to exceed P10,000 or imprisonment not exceeding five years, or both. Judgment affirmed.
