THE UNITED STATES, PLAINTIFF AND APPELLEE, VS. MARIANO VILLAVICENCIO, DEFENDANT AND APPELLANT.

D E C I S I O N

Defendant was convicted of robbery and sentenced to five years of presidio correccional.  The act was committed by mean of violence, as defendant, in a public street, tore away the two earrings the woman was wearing and took advantage of the darkness.  Condemmed to seven years of presidio mayor, with the accessories of article 57, Penal Code, and to restore the earring not recovered, or to pay the value.
