THE ROMAN CATHOLIC BISHOP OF JARO, PLAINTIFF AND APPELLEE, VS. GREGORIO DE LA PEÑA, DEFENDANT AND APPELLANT.

D E C I S I O N

Action to recover from defendant, as the administrator of Padre Agustin de la Peña, deceased, the amount of P6,641, the total of various sums delivered by the plaintiff to the deceased during his lifetime, for the purpose of erecting a hospital.  Defendant did not deny the receipt of the money, but alleged that it had been deposited in the banks, and confiscated later, with other moneys, by the American Government during the insurrection in the Islands.  Evidence found very unsatisfactory, and in the interest of justice, judgment reversed and new trial ordered.
