MAKASIAR, J.:
On May 17, 1977, the parties, assisted by their respective counsel, filed the following motion to dismiss dated May 3, 1977:
"COME NOW the parties in the above entitled case and to this Honorable Supreme Court respectfully move that the above entitled case be dismissed as they have fully settled their differences amicably and further declare that they have no claim against each other either pecuniary or otherwise and further declare that they release one another from any and all kinds of liability whatsoever.
