IN THE MATTER OF THE PETITION OF FONG CHECK TO BE ADMITTED A CITIZEN OF THE PHILIPPINES.  FONG CHECK, ALIAS GEORGE FONG, ALIAS GEORGE SOTO, PETITIONER-APPELLEE, VS. REPUBLIC OF THE PHILIPPINES, OPPOSITOR-APPELLANT.

R E S O L U T I O N

AQUINO, J.:

This is an appeal of the Solicitor General from the order of the Court of First Instance of Pampanga dated September 27, 1972, allowing Fong Check to take his oath of allegiance as a citi­zen of the Philippines.  The parties filed their briefs.  The appeal was submitted for decision on April 16, 1975. 

On October 21, 1976 Fong Check filed a manifestation stating that he had already been granted a certificate of naturalization under Letter of Instructions No. 270. 

The Solicitor General in his comment said that on June 9, 1976 Fong Check took his oath of allegiance as a Filipino citizen and was issued Certificate of Naturalization No. 6487 under LOI No. 270. 

IN VIEW THEREOF , the appeal is dismissed for having become moot.  No costs. 

SO ORDERED.
