SUMMARY
Plaintiff brought this action against defendants to recover P91,300.00 as damages for injuries sustained by him while passenger of the latter's vessel, caused by explosion of an oxygen Lank. After trial, the court sentenced the defendant shipping company to pay plaintiff the aggregate sum of P11,934.00. On direct,appeal by both parties, the Supreme Court certified the appeals to the court of Appeals.
RULING
Since appellant company did not file any brief, whereas that of appellant Roque raises mainly questions of fact, the appeals, in view of the amount involved, are within the exclusive appellate jurisdiction of the Court of Appeals (Sees. 17 and 29, R. A. 296, as amended by R. A. 2613).
