APPEAL from a decision of the Court of First Instance,
SUMMARY
Plaintiff-appellant sought to recover from the defendant-appellee, stock certificates representing 829 shares of stock of the Central Luzon Milling Co., Inc. with a par value of P100.00 each, supplies, furnitures and equipments with a total book value of P5,040.00 allegedly belonging to the estate of Ramirez. Defendant answered with a counterclaim also seeking to recover one steel safe and two typewriters valued at P825.00 from Ramirez. The trial court decided the case declaring defendant owner of the stock certificates and the articles mentioned in the complaint. The counterclaim was dismissed. Plaintiff appealed the judgment. On appeal, the Supreme Court certified the case to the Court of Appeals pursuant to Section 31 of the Judiciary Act as amended.
RULING
Under Sections 17 and 29 of the Judiciary Act of 1948 as amended, the Court of Appeals has the appellate jurisdictions of cases where the amount involved is less than P200,000.00. The amounts involved in the complaint and counterclaim are P87,940.00 and P825.00 respectively, the aggregate sum of which is less than P200,000.00.
