The Court having regularly acquired jurisdiction of the stove-entitled cause submitted by both parties for decision, after consideration thereof by the Court upon the record., Its decision and order for judgment having been filed on the 21st day of April, nineteen hundred and thirty-four;

By virtue thereof the writ of certiorari is hereby granted, but the record need not be elevated to this court for further action. The Public Service Commission is Instructed to have further proceedings in accord with the views expressed in said decision of this court, with costs against the Manila Railroad company.

It is further ordered that the Petitioner recover tram, the Manila Railroad Company the Bum of P64.00, as costs.
