We affirmed this in Rimando v. Aldaba,[83] where we were confronted with the similar issue of whether an accused's civil liability in the estafa case must be upheld despite acquittal and exoneration from civil liability in BP 22 cases. We held that both estafa and BP 22 cases can proceed to their final adjudication-both as to their criminal and civil aspects—subject only to the prohibition on double recovery.
