The RTC found that PNB was guilty of breach of contract as the credit agreements had been violated.  For its failure to release the balance of the approved loan, the construction of the Eduarosa Towers Condominium project was not finished, transgressing the very purpose of the credit agreements, that is, to finance the completion of the construction of Eduarosa Towers.  This factual finding was affirmed by the CA.  Thus, the Court is bound to uphold such finding.  "The settled rule is that conclusions and findings of fact of the trial court are entitled to great weight on appeal and should not be disturbed unless for strong and cogent reasons because the trial court is in a better position to examine real evidence, as well as observe the demeanor of the witnesses while testifying in the case.  The fact that the CA adopted the findings of fact of the trial court makes the same binding upon this Court."[24]
