As a rule, the perfection of appeal within the period required by law is mandatory and jurisdictional. Failure to appeal within such period results in the assailed decision becoming final and executory. As regards a motion for reconsideration of a decision of the NLRC, the same must be filed within 10 days from the receipt of the assailed decision. It must, nevertheless, be emphasized that the NLRC is not bound by the technical rules of procedure. Thus, in deciding labor cases, the NLRC is allowed to liberally apply its rules.[41]
