The ruling of this Court in People v. Montesclaros[76] is instructive on the apportionment of civil liabilities among all the accused-appellants. The entire amount of the civil liabilities should be apportioned among all those who cooperated in the commission of the crime according to the degrees of their liability, respective responsibilities and actual participation. Hence, each principal accused-appellant should shoulder a greater share in the total amount of indemnity and damages than Perpenian who was adjudged as only an accomplice.

In criminal cases, exemplary damages may be imposed on the offender as part of the civil liability when the crime was committed with one or more aggravating circumstances.[39] Nonetheless, it is required that the aggravating circumstance/s be alleged in the information and proved during the trial.[40]
