| Even in the face of accusations against him, Macario never testified in his defense. This goes against the principle that "the first impulse of an innocent man when accused of wrongdoing is to express his innocence at the first opportune time."[50] In the recent case of People v. Damaso Job,[51] appellant's conviction for kidnapping for ransom was affirmed since he did not give any plausible reason for his presence in the safe house.
