| Under the 2002 Revised Manual for Clerks of Court,[9] the branch clerk of court as the administrative officer of the court, among others, controls and supervises the safekeeping of court records.[10] Moreover, Section 7, Rule 136 of the Rules of Court specifically mandates the clerk of court to "safely keep all records, papers, files, exhibits and public property committed to his charge." As custodian of the records of the court, it is the duty of the clerk of court to ensure not only that the same are safely kept in his or her possession, but also those they will be readily available upon the request of the parties or order of the court.[11] | |||||
