However, the trial court failed to award civil indemnity to the complainant. We have ruled that if rape is committed or qualified by any of the circumstances which authorize the imposition of the death penalty, the civil indemnity shall be not less than P75,000.00. [48] For the other three counts of simple rape, where the proper penalty is reclusion perpetua, accused-appellant is liable for civil indemnity in the amount of P50,000.00 for each count. [49]

Finally, the victim should be awarded civil indemnity for the rape, in addition to moral damages in the amount of P50,000.00. An award for civil indemnity is separate and distinct from moral damages. Civil indemnity is automatically granted to the offended party without need of further evidence other than the fact of the commission of the crime and the accused's responsibility therefor.[16] The award of civil indemnity shall be in the amount of P50,000.00, following prevailing jurisprudence.[17]

For the foregoing reasons, we find no reason to reverse the decision of the trial court. The sentence of the trial court as well as its award of P50,000.00 as civil indemnity should be affirmed as it is in accord with our rulings. However, in accordance with our rulings in other cases,[32] accused-appellant should be ordered to pay complainant the additional amount of P50,000.00 as moral damages without necessity of proof other than the fact of rape.
