| Well-settled is the rule that certiorari will lie only when a court has acted without or in excess of jurisdiction or with grave abuse of discretion.[20] As a condition for the filing of a petition for certiorari, Section 1 of Rule 65 of the Rules of Court additionally requires that "no appeal nor any plain, speedy and adequate remedy in the ordinary course of law" must be available.[21] It is axiomatic that the availability of the right of appeal precludes recourse to the special civil action for certiorari.[22] | |||||
