| In Heirs of Federico C. Delgado v. Gonzalez,[38] we ruled that the preliminary investigation is part of a criminal proceeding. As all criminal proceedings before the Supreme Court and the Court of Appeals may be brought and defended by only the Solicitor General in behalf of the Republic of the Philippines, a criminal action brought to us by a private party alone suffers from a fatal defect. The present petition was brought in behalf of LBP by the Government Corporate Counsel to protect its private interests. Since the representative of the "People of the Philippines" had not taken any part of the case, it should be dismissed. | |||||
