| Zuñiga, as Clerk of Court, was entrusted with the delicate functions of collecting legal fees.[27] She acted as cashier and disbursement officer of the court and was tasked to collect and receive all monies paid as legal fees, deposits, fines and dues, and controls the disbursement of the same.[28] She was also designated as custodian of the court's funds and revenues, records, properties and premises, and should be liable for any loss or shortage thereof.[29] | |||||

| Consequently, in the application of payments, priority should be given to the Fiduciary Account as the funds therein are only held in trust by the Court and are subject to refund upon presentation of appropriate documents.[24] The OCA was, therefore, correct in stating that the FF shall be deducted first from the withheld salaries and accrued leave credits of Acedo. With that in mind, the balance of accountability of Acedo, as far as the FF is concerned, is as follows: Fiduciary Fund Final Shortage P850,577.20 Less: Total monetary value of accrued leave credits 640,015.84 Balance of Accountability P210,561.36 Thus, the total accountability of Acedo shall be: | |||||
