| While the right to cross-examine is a vital element of procedural due process, the right does not necessarily require an actual cross-examination, but merely an opportunity to exercise this right if desired by the party entitled to it.[26] Clearly, the BANK's failure to cross-examine is imputable to the BANK when it lost this right[27] as it was in default and failed thereafter to exhaust the remedies to secure the exercise of this right at the earliest opportunity. | |||||
