PEOPLE v. LAMBERTO BORJA Y MARTINEZ

This case has been cited 1 times or more.

BELLOSILLO, J.
At any rate, it was up to the defense to prove by clear and convincing evidence that the findings of the forensic chemist were erroneous. In the absence of such evidence, the positive results of the tests conducted by the chemist should be accepted as conclusive. After all, she has in her favor the presumption that she regularly performed her official duty, which was to carry out those tests in accordance with the accepted standard procedure.[22]
