| The evidence having established the commission of one (1) count of statutory rape and three (3) counts of rape, we find the imposition of reclusion perpetua to be in accord with Article 335 of the Revised Penal Code.[51] Though it has been proven that the rape was committed with the use of a deadly weapon, a knife, the penalty of death cannot be imposed because at the time it was committed, the death penalty had been suspended by the 1987 Constitution. | |||||
