| Contrary to law."[2] A second Information likewise accuses them of Attempted Murder, committed allegedly as follows:"That on or about the 15th day of May, 1997, in the city of Iloilo Philippines and within the jurisdiction of this Honorable Court, herein accused, conspiring, confederating and helping one another, armed with guns, with treachery and evident premeditation, with a decided purpose to kill, did then and there willfully, unlawfully, and criminally shoot Rose Padernal with the said gun which the accused were provided at the time: thus the accused have commenced the commission of the crime of murder directly to overt acts but did not perform all the acts of execution which would have produced the felony, as a consequence by reason of some cause or accident other than the spontaneous desistance of the accused. | |||||
