| Where facts are however adequately represented in the criminal case and no procedural unfairness or irregularity has prejudiced either the prosecution or the defense as a result of the improvident plea of guilty, the settled rule is that a decision based on an irregular plea may nevertheless be upheld where the judgment is supported beyond reasonable doubt by other evidence on record[35] since it would be a useless ritual to return the case to the trial court for another arraignment and further proceedings.[36] | |||||

| As to the damages awarded, modifications thereof are in order. In Criminal Case No. 5630 for rape with homicide, the indemnity should be increased from P50,000 to P100,000,[32] while the moral damages and exemplary damages should be reduced from P150,000 to P50,000 and from P50,000 to P25,000,33[33] respectively. | |||||

The prosecution then had all the opportunity to verify the material allegations in the information... | As to damages, the trial court awarded the heirs of the victim the sum of P50,000.00 as death indemnity, P100,000.00 as moral damages and exemplary damages, P83,900.00 as actual damages and P15,000.00 as attorney's fees plus costs of suit. In rape with homicide, the death indemnity was increased to P100,000.00 because the prevailing jurisprudence is that P50,000.00 for death and P50,000.00 for rape.[34] However, the award of moral damages is reduced to P50,000.00[35] while the exemplary damages and attorney's fees are deleted for lack of legal basis and the award of actual damages is likewise reduced to P18,000.00.[36] | |||||
