Unlike the subsidiary liability of the employer under Article 103[12] of the Revised Penal Code,[13] the liability of the employer, or any person for that matter, under Article 2176 of the Civil Code is primary and direct, based on a person's own negligence. Article 2176 states: Art. 2176. Whoever by act or omission causes damage to another, there being fault or negligence, is obliged to pay for the damage done. Such fault or negligence, if there is no pre-existing contractual relation between the parties, is called quasi-delict and is governed by the provisions of this Chapter.
