This case should be differentiated from that of Aniag, Jr. v. Commission on Elections,[150] which involved the search of a moving vehicle at a checkpoint.[151] In that case, there was no implied acquiescence to the search since the checkpoint set up by the police authorities was conducted without proper consultation, and it left motorists without any choice except to subject themselves to the checkpoint: It may be argued that the seeming acquiescence of Arellano to the search constitutes an implied waiver of petitioner's right to question the reasonableness of the search of the vehicle and the seizure of the firearms.
