Section 5 of E.O. No. 648 specifically mandates the HLURB Board of Commissioners to adopt rules of procedure for the conduct of its business and perform such functions necessary for the effective discharge thereof. Such grant of power necessary to carry out its functions has been held to be an adequate source of authority to delegate a particular function, unless, by express provision of the Act or by implication, it has been withheld.[11]

Under Presidential Decree (P.D.) No. 957, as amended by P.D. No. 1344, the HLURB (then National Housing Authority) has exclusive original jurisdiction on the following: (a) unsound real estate business practices; (b) claims involving refund and any other claims filed by a subdivision lot or condominium unit buyer against the project owner, developer, dealer, broker, or salesman; and (c) cases involving specific performance of contractual and statutory obligations filed by buyers of subdivision lots or condominium units against the owner, developer, dealer, broker, or salesman.[22] The decision of the HLURB is appealable within 15 days to the Office of the President (OP), and, if after 30 days the appealed decision is not reversed or amended by the OP, then it is deemed affirmed.[23] Thereafter, the case may be elevated via a petition for review to the Court of Appeals, and then to this Court.[24]

It is settled that rules of procedure are, as a matter of course, construed liberally in proceedings before administrative bodies.[39] Administrative bodies are not bound by the technical niceties of law and procedure and the rules obtaining in the courts of law.[40] Rules of procedure are not to be applied in a very rigid and technical manner, as rules of procedure are used only to help secure and not to override substantial justice.[41]
