| Before us is an appeal via a Notice of Appeal of the Court of Appeals Decision[1] in CA-G.R. CR.-H.C. No. 03219 affirming the Decision[2] of the Regional Trial Court (RTC), Branch 120, Caloocan City, which, in turn, convicted accused-appellant Magsalin Diwa (Diwa) of violation of Sections 5 and 11 of Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002. | |||||
