The settled principle is that "the allegations of the [C]omplaint determine the nature of the action and consequently the jurisdiction of the courts. This rule applies whether or not the plaintiff is entitled to recover upon all or some of the claims asserted therein as this is a matter that can be resolved only after and as a result of the trial."[21]

We address the preliminary matter of the nature of respondents' Complaint against petitioners.  Well-settled is the rule that the allegations in the complaint determine the nature of the action instituted.[24]

(2) the action in Bulao v. CA[27] was for damages predicated on a quasi-delict. Private respondent alleged that petitioner maliciously constructed a dam and diverted the flow of water, causing the interruption of water passing through petitioner's land towards that of private respondent and resulting in the loss of harvest of rice and loss of income.[28]
