Before us is a Petition for Review[1] under Rule 45 of the Rules of Court, seeking to set aside the April 26, 2001 Decision[2] and the February 5, 2002 Resolution[3] of the Court of Appeals (CA) in CA-GR SP No. 59724. The assailed Decision disposed as follows: "WHEREFORE, the petition is GIVEN DUE COURSE. The appealed decision of the Regional Trial Court of Quezon City (Branch 95) is REVERSED and SET ASIDE and another rendered DISMISSING the ejectment case."[4] On the other hand, the challenged Resolution denied petitioners' Motion for Reconsideration.
