| The judge has the discretion whether or not to declare a party non-suited.[27] It is, likewise, settled that the determination of whether or not an order of dismissal issued under such conditions should be maintained or reconsidered rests upon the sound discretion of the trial judge.[28] The next question to be resolved is whether there was grave abuse of discretion of the trial judge.
